Terms of service

PitchFive is operated by Zen Acquire LLC, an Ohio limited liability company (“Zen Acquire”, “we”, “us”). By creating an account or using the service you agree to these terms. If you are agreeing on behalf of an employer, you confirm you have authority to bind that organisation.

PitchFive lets employers collect structured video interviews and proctored skills tests from job applicants, and review them in a candidate management interface. We provide the software. We do not make hiring decisions, do not recommend or endorse candidates, and are not a party to any employment relationship between you and an applicant.

You are the data controller for applicant data you collect. You agree to:

• Use the service only for genuine recruitment for roles you are actually hiring.
• Comply with employment, anti-discrimination, privacy, and recording-consent laws in every jurisdiction your applicants are in. Some places restrict recorded interviews or require specific disclosures, and meeting those obligations is your responsibility.
• Make hiring decisions based on human review. Any AI-assisted summary in the product is advisory only and must not be the sole basis for rejecting a candidate.
• Honour candidate requests concerning their data, and not obstruct a candidate's ability to withdraw.
• Keep your account credentials secure and only give access to people entitled to see applicant data.

Candidates may withdraw an application at any time from their status link, which permanently deletes their recordings, answers, test results, and contact details. This happens immediately and does not require your approval. You agree not to attempt to circumvent it, and you accept that withdrawn data cannot be recovered.

You may not use PitchFive to harass, deceive, or discriminate against applicants, to collect data for purposes unrelated to a real hiring process, to post fake roles, to reverse engineer or resell the service, or to upload unlawful content. We may suspend accounts that do, and we may remove content that violates these terms or the law.

Paid plans are billed in advance, monthly or annually as selected. Fees are non-refundable except where required by law. We may change pricing with reasonable notice; changes take effect at your next renewal. You can cancel at any time, and cancellation takes effect at the end of the paid period.

You and your applicants keep ownership of the content submitted through PitchFive. You grant Zen Acquire a limited licence to host, process, and transmit that content solely to operate the service for you. We do not sell it, use it for advertising, or use candidate recordings to train machine learning models.

The service is provided “as is”. We work to keep it available and accurate but do not warrant uninterrupted or error-free operation. In particular, proctoring signals such as tab switching, pasted content, and screen-share type are indicators, not proof, and cannot detect activity outside the browser. Do not treat them as conclusive evidence of misconduct.

To the maximum extent permitted by law, Zen Acquire is not liable for indirect, incidental, or consequential damages, or for lost profits, lost data, or hiring outcomes. Our total liability for any claim is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

You may stop using the service at any time. We may suspend or terminate access for breach of these terms, non-payment, or unlawful use. On termination you can export your data for thirty days, after which we may delete it.

These terms are governed by the laws of the State of Ohio, United States, without regard to conflict of law rules. Disputes will be brought in the state or federal courts located in Ohio, and both parties consent to that jurisdiction.

We may update these terms. Material changes will be reflected in the date above, and continued use after a change means you accept the updated terms.
